German Trademarks

TrademarksIn Germany, trademark rights are obtained by filing a registration application with the German Patent and Trademark Office (GPTO), which is located in Munich. In general, the registration procedure will take approximately eight to twelve months from the filing date.  A German trademark application is examined with regard to absolute grounds, a search for prior art trademarks is not performed. Once the registration of a German trademark is published, a three month opposition period follows, where a third party can claim prior rights.

A German trademark application can claim priority to any other trademark within six months from the filing date of the other trademark, and can form the priority application for any other trademark application such as an EU Trademark or International Trademark.
