
The introduction of the Unified Patent Court (UPC) has been postponed. This is due to a very recent ruling by the German Constitutional Court.
The introduction of a law to regulate the approval of the UPC agreement in fact means a substantive amendment of the German Constitution. However, as this amendment was not adopted by the German Parliament with the required two-thirds majority, it was the subject of a complaint, which was upheld by the Constitutional Court.
With this ruling, the introduction of the UPC, following the earlier decision of the United Kingdom to refrain from participating in the UPC, again faces a sensitive setback.
